Judge flays man who killed senior citizen

KUALA LUMPUR: A judge today gave a tongue-lashing to a man found guilty of killing a senior citizen neighbour.

In sentencing Rasid Osias to a 20-year jail term, Judicial Commissioner Shariff Abu Samah told him that what he had done to his neighbour Swa Kim Cha @ Chua Ah May was akin to “killing” his own mother.

“Although she’s not of the same race as you, she lived next to you and was like your mother,” he told Rasid who appeared to be in remorse in the dock.

“You killed an old lady without reason and you have robbed a mother and grandmother from a family. I hope you can ‘bertaubat’ (repent) for your action,” added Shariff, who appeared teary-eyed.

Shariff handed Rasid a 20-year jail sentence after the latter pleaded guilty to culpable homicide not amounting to murder. “The court must ensure that this must not happen again. A strong message must be sent to the public,” he said.

Rasid, unemployed, was initially charged with murdering Swa at a low cost flat in Jalan Union, Off Jalan Sentul, on July 23, 2014. The prosecution amended the charge to culpable homicide not amounting to murder halfway through the case.

According to the facts of the case, Rasid went to his neighbour’s house on July 23 armed with a knife allegedly with the intention of robbing her. Swa opened the door for him when he said that he wanted to borrow a water pail.

Rasid trailed her to the toilet. As Swa was about to get a pail from the toilet, he slashed her from behind.

Swa screamed for help and struggled with the accused. Rasid stabbed her, during the struggle, in the chest.

Rasid was represented by Kitson Foong and Chew Jee San.
