Trader fined RM1,000 for assaulting elder sister

KUALA LUMPUR: A steamboat eatery operator was fined RM1,000 or one month in jail by the Magistrate’s Court here today after he pleaded guilty to causing hurt to his older sister.

Magistrate Mohd Faizal Ismail passed the sentence on Herman Syah Muslim, 53, for injuring Yuliarti, 54, by hitting and punching her several times in the face, shoulder, head and body.

He committed the offence at the victim’s house in Jalan Raja Alang, Kampung Baru here at 4pm on June 29, under Section 323 of the Penal Code which provides for a jail sentence of up to a year or a fine of RM2,000, or both.

According to the facts of the case, the incident happened in the compound of the victim’s house after she refused to pay the cost of treatment for their father amounting to RM2,800 shared with other siblings.

Counsel Fahmi Adilah mitigated for a light sentence, submitting that the accused was the sole provider for his family and had three school-going children.

He added that it was the accused’s first offence and that Herman was sorry for committing it.

Deputy Public Prosecutor Farah Aimy Zainul Anwar urged the court to mete out an appropriate sentence.
