PETALING JAYA: Minister in the Prime Minister’s Department Azalina Othman Said says the Election Commission (EC) will maintain its current administrative structure and that its independence is provided for by law.
“The fact is that the establishment of the EC is based on the constitution,” she said in a written reply.
She pointed to Article 114 of the Federal Constitution which states that EC members are to be appointed by the Yang di-Pertuan Agong after consultation with the Conference of Rulers.
Article 114(2) meanwhile states the importance of an EC which enjoys public confidence, she said.
She added that the EC believed the current administrative structure was still relevant.
Azalina was responding to M Kulasegaran (DAP-Ipoh Barat), who had asked the prime minister to state whether the government was ready to change the EC to an independent body which would report directly to Parliament.
The EC currently comes under the Prime Minister’s Department.
Azalina said based on Article 113 of the Federal Constitution, the EC is responsible for conducting the redelineation process and conducting elections, among others.
