Man seeks review of jail sentence on 600 charges of rape, sodomy

KUALA LUMPUR: A man who was sentenced to 48 years in jail on more than 600 charges of sodomising, sexually assaulting and raping his daughter, now claims the jail sentence is “defective”.

Lawyers representing the man told the High Court during case mention today that they wanted to review the conviction and jail sentence meted out by the Sessions Court last year.

Rajesh Nagarajan, representing the divorcee, told judge Azman Abdullah the sentence over the 623 charges did not comply with the Criminal Procedure Code (CPC).

“We were informed that all charges were not read to him again when he pleaded guilty during the second case mention,” he said.

Rajesh also said the man had not been allowed to meet his family members from the time of his arrest until he was brought to court, neither was he informed of his right to legal representation.

“He did not see anyone throughout the time he was in custody and the court did not ask if he wanted a lawyer to fight his case,” he said.

In fixing May 16 for hearing, Azman asked Rajesh and deputy public prosecutor Aimi Syazwani Sarmin to obtain the lower court’s recording of the proceedings on the day when the man pleaded guilty to all charges.

Cyrus Tiu is also representing the man, together with Rajesh.

The former insurance agent pleaded guilty to 623 charges in September last year at Putrajaya’s Special Court for Sexual Crimes Against Children to sodomising, raping and sexually abusing his daughter from January to July the same year.

It was reported that the man had sodomised, raped and sexually assaulted his daughter since his divorce in 2015.

The daughter had gone to live with him and only revealed her ordeal to her mother after learning that her father was planning to take her two younger sisters to live with them as well.

The man later appealed against the court’s decision on the jail sentences and caning.
