PUTRAJAYA: A former lorry attendant, who was unrepresented, was successful in getting the Court of Appeal to reduce his jail term for sexually assaulting his underaged daughter.
The 51-year-old man, who was sentenced to a total of 75 years’ imprisonment for five offences in the trial court, had his custodial sentence reduced to 49 years.
However, the bench chaired by Mohtarudin Baki maintained the eight strokes of the rotan imposed on the man.
In his mitigation, the man only pleaded for leniency.
Mohtarudin in allowing the reduction in the jail term said there was merit in the appeal.
Sitting with him were Justices Abdul Karim Abdul Jalil and Rhodzariah Bujang.
According to the facts of the case, the accused committed the offences in the Kota Tinggi district in Johor between May 2011 and February 2015.
The incidents took place when the girl was between 11 and 15 years old. She finally lodged a police report in late 2015.
The first charge stated that the father had an incestuous relationship with the girl, and the trial court sentenced him to 25 years’ jail and three strokes of the rotan.
He was also jailed 15 years and ordered to be given two strokes of the rotan for sodomising the girl.
The father was also given another six years for molest.
However, the Sessions Court last year ordered the offences for sodomy and molest to run concurrently, meaning he was to serve only 15 years.
On the third charge, he was also sentenced to 28 years’ jail and ordered to be given three strokes of the rotan for having an incestuous relationship.
The father was also given another seven years for molesting the girl.
In March this year, the High Court in Johor Baru dismissed the man’s appeal against the sentence.
Today the Court of Appeal reduced the jail term to 18 years (incestuous relationship), 10 years (sodomy and molest), 18 years (incestuous relationship) and three years (molest).
