PETALING JAYA: The Election Commission (EC) today said disqualified MP C Sivarraajh cannot contest the upcoming by-election in Cameron Highlands on Jan 26, 2019.

Its chairman Azhar Harun said the EC has come to a conclusion to bar Sivarraajh from contesting the polls after reviewing the Election Court’s Nov 30 judgment and the law governing elections and seeking legal advice.

“He cannot contest in any elections for the next five years, neither can he take part in any elections as a voter,” Azhar said in a statement today.

Last month, the Election Court nullified Sivarraajh’s May 9 victory in Cameron Highlands, on the grounds of vote-buying.

In allowing an election petition by his opponent from DAP, M Manogaran, the court ruled that Manogaran had proven beyond doubt that money was given to voters during the campaign.

Sivarraajh decided not to appeal against the court’s decision and expressed his desire to contest in the by-election.

“I would rather Barisan Nasional (BN) fight for the cause of the people in a by-election than take up a legal case,” he had said.

The nomination for the Cameron Highlands by-election has been fixed for Jan 12, 2019, while the voting will be held on Jan 26, 2019.
