
SHAH ALAM: The High Court here has awarded RM50,000 in damages to a former police officer who sued the government for false imprisonment.
Judge Roslan Abu Bakar said R Raj Kumar had proved his case on the balance of probability.
“The plaintiff’s declaration that he was under unlawful detention for 43 days is also allowed,” said Roslan, who delivered the ruling in an online proceeding.
Raj Kumar, represented by A Srimurugan, was initially charged in the Petaling Jaya sessions court 10 years ago with kidnapping but was acquitted in 2015.
The same year, he filed the suit on the grounds that his detention after he was charged was without a valid remand order by the court.
He named seven defendants, including investigating officer Maizali Mohamed and the government.
His suit was first struck out by the High Court, but on appeal, the court restored it and ordered it to be heard before another trial judge.
The defendants said the detention was valid and the suit was filed out of time as the breach took place in 2012.
Federal counsel Nur Aifaa Che Abdullah represented the defendants.
