Contempt of court or abuse of power?

Lawyer Arun Kasi was charged with contempt by Tommy Thomas for alleged hateful statements pertaining to the case of Leap Modulation Sdn Bhd vs PCP Construction Sdn Bhd, where the Federal Court decided to erase a dissenting judgment by Court of Appeal judge Hamid Sultan Abu Backer.

The senior lawyer will now be sleeping behind bars for 30 days while Tommy and the rest of the lawyers sleep comfortably at home.

Citing Arun for contempt for just making comments about the judiciary’s practice is complete nonsense. Arun’s articles came after a big whistle-blowing by Hamid. Like Arun, many others also made comments and urged an investigation into the judiciary.

It is complete hypocrisy as Thomas himself knows the facts about the judiciary. Thomas wrote on page 151 of his book “Abuse of Power” that “the court cannot gain respect by contempt orders; respect has to be earned over time by proper judicial conduct and correct judicial decision”.

Thomas may have forgotten his own words. It’s a complete disgrace to the whole legal profession. Thomas’ action has set a bad precedent.

I see this as a complete “Abuse of Power” by the writer of the book. I have completely lost the hope that I had when you were appointed as the attorney-general, Mr Tommy.
