Sabah lawyer sues Hadi for anti-Christian statement

Senior Sabah lawyer Marcel Jude L M S Joseph is taking PAS President Abdul Hadi Awang to Court for a statement in Free Malaysia Today, “Christianity rejected by the educated, says Hadi”. Hadi’s conduct in the “offending” article, alleged Marcel Jude in his e-filing on Tuesday, was “despicable, blasphemous, and was undertaken by the defendant with willful and conscious disregard inter alia the reputation of the plaintiff”.

Marcel Jude referred to paragraphs one to six in the said article sourced from Harakah the PAS organ, and said that Hadi made several defamatory statements.

Briefly, said Marcel Jude, Hadi claimed that Christian missionaries only brought their work to Malaysia after experiencing failure in the west (1st para); Christianity was no longer saleable in countries where the education level was high (2nd para); after being rejected in the west, Christian missionaries have taken their teaching to African countries, where the people are far from being educated and civilized, and also to the interior areas of Sabah and Sarawak (3rd para); people who are hemmed in by difficulties would easily accept their assistance and, in the end, become influenced by them (4th para); it’s a danger that must be fought (5th para); and, in citing the example of an unnamed Canadian woman who embraced Islam, Hadi said that Christian preachers would often back down from challenges to debate with their Muslim counterparts “because they know that they would lose” (6th para).

Marcel Jude said in his lawsuit that he had, in consequence, been seriously injured in his character, credit and reputation and had been brought into public scandal, odium and contempt and hurt in his feelings. He added that the said statements were calculated to make negative and false inferences of the plaintiff and his faith and religious belief.

Alternatively, said Marcel Jude, the defendant’s statements were lies uttered with malice, in that the defendant knew it was false or would cause damage or harm. “The defendant, by reason of making such false statements, had intended to publish injurious falsehood and slander against the plaintiff and the defendant knew or was reckless as to whether the said statements were not true.”

Marcel Jude claimed that, in consequence thereof, the plaintiff was entitled to an additional award of punitive and/or exemplary damages in an amount sufficient to punish the defendant and to deter the defendant from committing such “despicable acts” or making “such blasphemous statements” in the future.

The plaintiff, in the lawsuit, claims damages for defamation, blasphemy, injurious or malicious falsehood and slander, punitive damages, injunctive relief, statutory interest, cost and any other relief deemed fit by the Court.
