Habeas corpus filed to release Sanjeevan

Lawyer Gobind Singh also files a certificate of urgency to have the hearing heard soon, before the 21-day detention under Poca ends on July 31.

After failing to get the High Court to review his 21-day detention under the Prevention of Crime Act (Poca), a habeas corpus application was filed to release MyWatch chairman R Sanjeevan from detention.

His lawyer, Gobind Singh, said they filed the application on Friday at the High Court registry.

“We asked the High Court to review the magistrate’s decision on Monday that granted the police 21 days’ remand (on Wednesday),” he said after filing the habeas corpus application.

“However, the court replied yesterday that it found no reason to review the magistrate’s order.”

The 21-day Poca detention ends on July 31.

Gobind said he has also filed a certificate of emergency to have the hearing heard soon, before the remand ends.

“Otherwise, the habeas corpus application will be academic,” he said.

Sanjeevan’s wife Dr K Kastoori, in her affidavit for the habeas corpus application, charged that her husband’s detention was unconstitutional.

“My husband was detained under the 2014 amended Section 4(1)(a) of Poca.”

The amendment was done in accordance to Article 149 (Federal Constitution), she noted.

“It allows Parliament to make laws to prevent actions that are prejudicial to public order.”

However, she added, it was not in line with Article 151 when the amendments were passed.

“An advisory board should be formed to consider any representations made by him.”

Sanjeevan was first arrested on June 23 at the Nilai toll plaza, with his driver, for allegedly blackmailing an illegal gambling syndicate for RM25,000.

He allegedly threatened to expose the syndicate if it did not meet his demands.

Subsequently, he was re-arrested six times.
