
Azmin is seeking a court order to compel Khalid Abu Bakar to take the necessary actions to locate, arrest and produce Low before a magistrate to face various criminal charges.
Speaking to reporters after his lawyer filed the judicial review application at the High Court, Azmin said he had no personal motive against the IGP but was merely exercising his right as a Malaysian taxpayer.
“I want to remind the IGP that he has a duty under the Police Act to bring culprits to justice,” he said.
He also said he had given sufficient notice to the IGP to take action against Low.
“His explanation that he had to turn down my demand as the 1MDB investigations are ongoing is unacceptable.
“The authorities in several other countries have already prosecuted those involved in the 1MDB scandal,” he said.
On Aug 1, Azmin wrote to the IGP demanding that he took relevant actions against Low for alleged wrongdoings under various criminal laws.
However, Khalid said he would not comply with Azmin’s demand because the investigations into the embattled state-owned firm and those with links to it was still ongoing.
“Go ahead and take legal action. I’ll wait (for it),” he had said.
In November 2015, the home ministry, in a parliamentary reply to Kelana Jaya MP Wong Chen, said the government had been unsuccessful in locating those needed to facilitate investigations into 1MDB.
Low was one of the individuals needed for the investigations, along with 1MDB’s former senior executives Casey Tang Keng Chee and Jasmine Loo Ai Swan, 1MDB’s former subsidiary SRC International managing director Nik Faisal Ariff Kamil, and Deutsche Bank country manager Yusof Annuar Yaacob.
