Maria Chin fails to strike out ‘illegal’ rally charge

The High Court has no jurisdiction to cancel Chin's application at the Sessions Court.

KUALA LUMPUR: Activist Maria Chin Abdullah failed on Monday to strike out a charge for organizing the Bersih 4 rally, held in August last year.

In dismissing the Bersih 2.0 chairman’s application, High Court Judge Mohamad Shariff Abu Samah said she failed to notify the Brickfields police 10 days before the rally as stipulated in Section 9 (1) of the Peaceful Assembly Act. “The application has no merit,” he said.”

“The High Court has no jurisdiction to cancel Chin’s application at the Sessions Court.”

Chin’s lawyer, Ambiga Sreenevasan, said they would appeal the ruling of the High Court.

In November, Chin claimed trial for failing to notify authorities ahead of the rally.

If convicted, she can be fined up to RM10,000 under the Act.
