Court to hear three judicial reviews on AG separately

The High Court finds that there’s merit in arguments against combining the judicial reviews.

The High Court decided to hear separately three applications for judicial reviews challenging Attorney-General Mohd Apandi Ali’s decision against prosecuting Prime Minister Najib Abdul Razak for alleged wrongdoing.

Lawyer Fahri Azzat, acting for the Bar Council, conveyed the decision to reporters after hearing in chambers. “The court found that there’s merit in our objections against combining all the judicial reviews,” he said.

The court has fixed July 29 to hear the leave to commence judicial review taken by former de facto Law Minister Zaid Ibrahim.

Sacked Umno Batu Kawan divisional vice- chief Khairudin Abu Hassan’s application will be heard on August 12 and the Bar’s leave on August 25.

Zaid, Khairuddin and the Bar Council filed separate judicial reviews to set aside Apandi’s decision not to commence prosecution on the RM2.6 billion political “donation”, SRC International and 1MDB cases.

Zaid, in a statement on February 2, said that he filed an application for judicial review for several reasons.

Firstly, to set aside the decision of the AG not to prosecute Najib.

Secondly, on the AG instructing and/or advising the MACC to close its investigations on 1MDB. He wants a declaration that the decision of the AG to compel the MACC to close its investigations was ultra vires his powers under Article 145(3) of the Federal Constitution.

Thirdly, to compel the AG to utilize his discretion under Article 145(3) to properly consider instituting criminal proceedings against Najib.

Khairuddin is seeking to quash Apandi Ali’s decision not to prosecute Najib on the donation, and for abuse of powers in transferring funds from Kumpulan Wang Persaraan to SRC International.

In March, the Bar Council filed a judicial review to set aside the AG’s decision to close investigations on the RM2.6 billion donation and the funds from SRC International entering the Prime Minister’s accounts.
