Safety ‘failure’ reason for M’sian girl’s death at Aussie ride

Several blunders had allegedly occurred in the days before Adelene Leong was flung 10m from the AirMaxx 360 ride at the Royal Adelaide Show on 12 September 2014.

KUALA LUMPUR: In a statement of summons filed at the Industrial Magistrate’s Court in Adelaide, Australia, it has been alleged that an eight-year-old Malaysian girl died at the Australian Fair in 2014 because of the failure of safety inspection, according to The Advertiser.

Adelene Leong, who was on holiday with her mother, died when she was flung from a ride. She suffered critical injuries from the fall and died in the Women’s and Children’s Hospital in Adelaide.

Police, who confirmed that Leong met the 120cm height restriction, have cleared the ride’s employees of wrongdoing.

The Advertiser, which sighted the documents filed in Court, reported that several blunders had allegedly occurred in the days before Leong was flung 10m from the AirMaxx 360 ride at the Royal Adelaide Show on 12 September 2014.

Among other allegations in the documents by prosecutors, it was stated that safety inspection company Safe is Safe Pty Ltd director and engineer Hamish Grant Munro “failed in testing the condition and effectiveness of the ride’s harness, safety locks and connecting pins”.

Munro was further alleged to have failed to detect that the ride’s, “Primary lock cylinder rod was unthreaded”.

It was also alleged by prosecutors that Munro had “failed to ensure that an appropriately competent person had reviewed the ride’s electrical systems, electronics and controls”.

SafeWork SA, South Australia’s safety watchdog, alleged in 15 separate charges that despite various mistakes, Munro had still certified the ride for use. “The certification, without reasonable excuse, exposed a class of individuals to whom it owed a health and safety duty … to a risk of death or serious injury from being ejected from the device while it was in operation,” The Advertiser quoted prosecutors as summing up.

“Adelene Leong died from injuries sustained from being ejected from seat 15 of the device while it was in operation.”

Safe is Safe Pty Ltd and Munro are facing corporate charges after director of public prosecutions Adam Kimber announced that there was “insufficient evidence” for launching criminal proceedings involving manslaughter.

The charge as it stands, a “Category 1” health and safety offence, carries five years jail at the very maximum and fine up to A$300,000 (RM884,530) for any individual involved and up to A$1.5M in business penalty.
