Sessions Court judge Zulqarnian Hassan discharged and acquitted Zubair after deputy public prosecutor Ahmad Akram Gharib said the prosecution did not wish to proceed with the case.
“We invoke Section 254(1) of the Criminal Procedure Code (CPC),” he said. “We cannot prove the case ‘beyond reasonable doubt’.”
Zubair had sent a letter of representation on July 22, he added, seeking to drop the charges against him. The case was under Section 409 and 418 of the Penal Code.
It was alleged, under Section 409, that he had failed to act on the award of the NCR land, in Sarikei, Julau and Kapit in Sarawak, to Vertical Drive Sdn Bhd and Nature Ambience Sdn Bhd.
His alleged act had caused Sime Darby to suffer RM100 million in losses when it had to acquire the two companies.
On the two alternative charges, under Section 418, it was alleged he did not inform the Sime Darby Board of Directors that the NCR lands had been awarded to Vertical Drive and Natural Ambience.
On March 24, Zubair was ordered by the Federal Court to stand trial after he failed to strike out the charges.
He was represented by lawyers Yusof Zainal Abiden and Stanley Augustin.
