Joint hearing for Najib, Arul Kanda in 1MDB audit case

Fiat prosecutor Gopal Sri Ram says the prosecution will also apply for both cases to be transferred to the High Court.

KUALA LUMPUR: The Sessions Court today allowed an application for the audit report tampering case involving former 1MDB executive director Arul Kanda Kandasamy to be heard together with that of former prime minister Najib Razak.

The request was made by fiat prosecutor Gopal Sri Ram before Sessions Court judge Azura Alwi.

Arul was accused of abetting Najib in the offence, which was said to have taken place at the Prime Minister’s Office between Feb 22 and 26, 2016.

He was charged under Section 28 (1)(c) of the Malaysian Anti-Corruption Commission (MACC) Act, which carries a jail term of 20 years and a fine of RM10,000.

Arul’s case was initially mentioned before Sessions Court judge Rozina Ayub before being transferred to Azura’s court.

Gopal also requested a mention date on the first week of March, and said the prosecution would apply for both cases to be transferred to the High Court.

He added that the related documents would be made available by then.

Arul’s lawyer, N Sivanathan, raised no objections to the request.

Azura then fixed March 1 for mention.

Najib and Arul are out on bail of RM500,000 each.

Najib, who was represented by Muhammad Farhan Shafee, was charged over allegations that he tampered with the 1MDB audit report before it was tabled to the Public Accounts Committee. He was accused of using his position to obtain immunity from legal action.

Najib was charged under Section 23 of the MACC Act, which also carries a jail term of 20 years and a fine of RM10,000.
