Court upholds 122 property buyers’ win against developer

Appellate court upholds the striking out of a defamation lawsuit brought against buyers by a developer.

PETALING JAYA:
The Court of Appeal today upheld a lower court’s decision to strike out a defamation suit by a developer against 122 buyers over posts they made against them on two social media platforms.

A three-member panel led by appellate judge Mohamad Zabidin Mohd Diah affirmed an earlier decision by the High Court in Kuala Lumpur favouring the buyers.

He further ordered RM8,000 in costs. Others in the panel in a Zoom session today included Azizah Nawawi and Nantha Balan ES Moorthy.

Developer Wawasan Rajawali Sdn Bhd had sued the 122 buyers over alleged defamatory statements against them on Facebook and Instagram, contending that the posts referred to them by way of innuendo.

According to the buyers’ lawyer, V Rajadevan, his clients then sought to strike out the case because there was no cause for action, as the posts did not name the developer of the project.

Wawasan Rajawali then went on to appeal against the High Court’s decision.

Andrew Chiew, Ho Ai Ting and Aaron Mah appeared for the developer.
