
He said the proposals include transferring the power to appoint and dismiss the chief commissioner and other MACC officers from the Cabinet to Bersih’s proposed anti-corruption service commission, Sinar Harian reported.
He said an additional clause to Article 141B of the Federal Constitution would be necessary to establish the commission.
“The second proposal is that the Public Officers (Conduct and Discipline) Regulations 1993 be amended to transfer the power to terminate public officers in public interest cases from the government to the commission.
“Additionally, Articles 132 and 135 of the Federal Constitution need to be amended to protect the interests and rights of public servants,” he said when presenting the report at a forum, MACC Reform: What Is Needed, in Shah Alam today.
“Another proposal is that the MACC chief commissioner – appointed at the discretion of the Yang di-Pertuan Agong, based on the prime minister’s advice – should remain and not be dismissed unless there is misconduct or incapacity.
“The final proposal is to set a five-year term limit for the commissioner,” he added.
He said these proposals will be submitted to law and institutional reform Azalina Othman Said shortly.
Faisal said the current MACC model has been tested but clearly does not function well.
“In light of what happened in the context of major corruption issues like the 1MDB, we must reform. We cannot be content with the current situation, which clearly has been proven to not function effectively.
“This is the best time to implement reforms. We understand it requires space and time but there needs to be progress to present in Parliament,” he said.
