Lawyer fails in bid to challenge cops, govt over seizure of accounts

The High Court here has dismissed lawyer Rosli Dahlan’s bid to challenge a decision by the police and government to freeze four Amanah Saham Nasional Bhd (ASNB) accounts belonging to him over money laundering allegations.

Justice Wan Ahmad Farid Wan Salleh said Rosli’s accounts were seized as part and parcel of police investigations.

“The investigations have yet to be completed. It is premature for the court to conclude that the investigations are tainted with bad faith,” he said.

Wan Farid added that Rosli is free to seek remedies in the courts over his grievances once investigations are completed.

“I note that the applicant (Rosli) has obtained leave to commence judicial review in another case against the police for wrongful detention. The government has also filed an appeal.

“I understand why my learned brother (Justice Ahmad Kamal Shahid) granted leave in that case,” the judge said.

Wan Farid also noted that in the present case the DPP was alleged to have acted on “false information” from the police.

“However, there is no evidence that the DPP acted in bad faith when he issued the seizure orders,” he said.

The judge made no order as to costs.

Rosli was seeking to challenge the seizure on grounds that the police and government had acted in bad faith.

Rosli was represented by lawyer DP Naban while senior federal counsel Rahazlan Affandi Abdul Rahim appeared for the police and government.
