Car ran over student’s torso, witness tells cop’s murder trial

A child witness who was near the scene said a policeman's car hit a student's motorcycle, throwing him on the road.

The Ipoh High Court was told today that a policeman’s car ran over student Zaharif Affendi Zamrie after he was thrown to the road in a collision between a policeman’s car and his motorcycle.

The statement was made by a child witness who was near the location of the collision between a Perodua Ativa car and Zaharif on a Yamaha LC motorcycle.

The Ativa was driven by senior police officer Nazri Abdul Razak, who is on trial accused of murder in the death of Zaharif, 17, on Dec 15.

The witness said Zaharif was thrown backwards, falling on the road after being struck by the Ativa. The front and rear right tyres of the car ran over his body, between the stomach and chest, the witness said.

The witness added that the victim’s head was under the car when he was run over.

“After witnessing the incident, I immediately went towards Zaharif with other friends to help him,” the witness said.

“Not long after, a man who came out of the Ativa car came over to us and said in an angry tone: ‘Lift him, we must take him to the (police) station.’

“I said to the Malay man: ‘Don’t lift him. He just had an accident. We can’t move him, we’re worried his bones might shift,” said the witness.

The witness said that before the collision, Zaharif had been loudly revving his motorcycle several times when the Ativa stopped next to him.

According to the witness, the Ativa car followed Zaharif towards the mosque in the area.

“Zaharif and the Ativa passed over a speed bump near the mosque, and both accelerated. Zaharif slowed down his motorcycle as they approached the junction, and I saw the rear brake light come on.

“Then I saw the Ativa hit Zaharif from behind. The Ativa car did not stop before the crash,” said the witness, reading from a written statement before High Court judge Bhupindar Singh Gurcharan Singh Preet.

The witness also said several unidentified individuals who were at the scene carried Zaharif, who was semi-conscious and weak, to the side of the road.

“At that moment, I saw the Ativa car inch closer to Zaharif, and the man opened his door, wanting to take Zaharif to the police station.

“However, those at the scene stopped the man from doing so because they were concerned that he said he wanted to take Zaharif to the police station, not the hospital,” the witness said.

The witness said the man then closed the car door and returned to check on Zaharif until the victim’s sister and father arrived, after which he left.

The court also called Ipoh City Council engineering department director Ridza’uddin Radzi as a witness to confirm details regarding the road and traffic signs around the scene.

Ridza’uddin said the area has two speed bumps and four warning signs for the bumps, and that the speed limit in the area is between 30-40km/h.

Deputy public prosecutors Afzainizam Abdul Aziz, Nasrul Hadi Abdul Ghani, V Suloshani and Low Qin Hui led the prosecution.

Appearing for the accused were lawyers M Athimulan, Mior Faridalathrash Wahid and Aiman Hakim Kamaruzzaman.

During cross-examination, Athimulan requested the court’s permission for the defence to visit the scene before starting the cross-examination proceedings. The judge then adjourned the proceedings, with the trial to resume tomorrow.

Nazri, 45, is charged with murder in the death of Zaharif on Jalan Taman Jati 1, near SMK Jati, between 11.45am and 12.40pm on Dec 15, 2023.

The charge carries the death penalty or imprisonment for 30 to 40 years and a minimum of 12 strokes of the rotan on conviction.
