Soldier charged with sexually assaulting 2 girls, possessing porn

A soldier was charged at the Ayer Keroh sessions court today with two counts of physically assaulting two underage girls as well as possessing pornographic images and videos on his phone.

Fudhail Fathollah Hamdan, 23, claimed trial when the charges were read to him before judge Raja Noor Adilla Raja Mahyaldin, reported Berita Harian.

Fudhail was charged with physical sexual assault against an eight-year-old girl by pulling her into a house and pushing her against a wall.

Fudhail was charged with committing a similar offence against a 10-year-old girl.

Both offences allegedly took place at an unoccupied house at No 35, Jalan Serindit, Kem Terendak, Sungai Udang, Melaka Tengah, at around 4.30pm on April 12

The charges were framed under Section 14(a) of the Sexual Offences Against Children Act 2017, which carries a maximum penalty of 20 years’ imprisonment and whipping upon conviction.

Fudhail was also charged with possessing obscene images and videos stored on his iPhone 15 Pro Max.

He was charged under Section 292(a) of the Penal Code, which provides for up to three years’ imprisonment, a fine or both if convicted.

The offence allegedly occurred while he was at the Melaka police headquarters’ sexual, women and child investigations division (D11) at about 8pm on April 13.

Investigations revealed that the victims were playing with friends when the accused, who was unknown to them, allegedly called them over under the pretext of asking for help to carry some items into a house.

He is then believed to have taken advantage of the situation by molesting the girls.

The traumatised victims later informed their families, and the suspect was arrested in the vicinity.

The prosecution proposed bail of RM40,000 for all charges with one surety, along with additional conditions deemed necessary by the court, including having no contact with the victims or prosecution witnesses and reporting monthly at the nearest police station.

The defence requested a reduction in bail, saying the accused is due to be married at the end of the year.

The court allowed bail of RM8,000 with one surety, subject to the prosecution’s requested conditions.

The case has been fixed for mention on May 26 for document submission.
