
They said three seats on the five‑member board, reserved for appointees of the Yang di‑Pertuan Agong, have yet to be filled.
“In accordance with our constitutional scheme, these appointments are made on the advice of the federal government,” one source told FMT.
Under Article 42(6) of the Federal Constitution, all members hold office for three-year terms and are eligible for reappointment.
It is not known how long the three seats have remained vacant, as there are no public records that identify past appointees, their appointment dates and when their tenure ended.
Pursuant to Article 42(8) of the constitution, the FTPB meets in the presence of the king, who presides over it. The constitution does not prescribe how many times the board must sit in a year.
“However, the full quorum of five will have to sit to deliberate to grant pardon, reprieves and respites, or to remit, suspend and commute sentences imposed by the court,” the source added.
FMT has sought the comments of Attorney‑General Dusuki Mokhtar, the government’s chief legal adviser and a member of the board, and is awaiting his response.
Article 42(5) provides that the attorney-general is a member of the board.
Hannah Yeoh presently sits on the board by virtue of her position as federal territories minister.
