
Adam Harith Ahmad, 18, and his girlfriend, aged 17 years and 10 months, entered their pleas before magistrates Sharda Shienha Mohd Suleiman and Uthman Abd Ghani, respectively, according to Sinar Harian.
Adam was charged with concealing the birth by wrapping the body of the baby, which allegedly died during childbirth, in the boot of a car at Kampung Batu Gajah, Merlimau, at about 11.40pm on April 25.
He was charged under Section 318 of the Penal Code, which carries a maximum jail term of two years, a fine, or both, upon conviction.
Deputy public prosecutor Syaza Nur Sharif proposed bail at RM15,000, but defence lawyer Farid Abdul Aziz appealed for a lower amount, citing Adam’s young age and the fact that his mother is a retired single parent who also cares for his grandmother.
The court allowed him bail of RM3,500 and fixed June 10 for case mention and submission of reports.
His girlfriend was charged with taking the drug Misoprostol with the intention of preventing the baby from being born alive.
She was alleged to have committed the offence at a house at Taman Sutera Wangi in Batu Berendam, Melaka Tengah, at about 10am on April 25.
She was charged under Section 315 of the Penal Code, which provides for up to 10 years’ imprisonment, a fine, or both, upon conviction.
The girl, who was unrepresented, appealed for a lower fine on the grounds that she is a juvenile.
The court granted her bail of RM1,500 and set July 9 for the submission of reports.
