
“I will explain that tomorrow in Sabah. I will go to Sabah,” he told reporters after Friday prayers at Kampung Batu Muda near Batu Caves.
His remarks came in response to Gabungan Rakyat Sabah’s stance that the latest review of the revenue entitlement rate under Articles 112C and 112D of the Federal Constitution must be carried out this year.
GRS secretary-general Armizan Mohd Ali said the federal government is committed to correcting the previous administration’s official position, including conducting a review of Sabah’s 40% revenue entitlement.
In April, the Court of Appeal allowed the federal government’s application for a stay of execution on a High Court order regarding Sabah’s entitlement to a 40% share of net federal revenue derived from the state, pending the disposal of an appeal.
Anwar said last November that Putrajaya had only appealed against the grounds of judgment, not the ruling itself, after discovering errors.
The Attorney-General’s Chambers said the judgment had alleged, among other things, that both the federal and state governments had abused their powers and breached their constitutional obligations.
On Oct 17, the Kota Kinabalu High Court ruled that the federal government had acted unlawfully by failing to honour Sabah’s 40% share of net federal revenue derived from the state for nearly five decades.
The court directed the federal government to conduct a review with Sabah to determine the quantum of the state’s entitlement for each financial year from 1974 to 2021.
It also ruled that the review must commence within 90 days of the delivery of the judgment and be completed within 180 days, or by April 15.
