Magistrate made the decision following an application by deputy public prosecutor Abdul Razak Musa.
The accused A Murugan, 44, was represented by R Thirukumaran while Simon Sabapathy held a watching brief for Kevin’s brother, Richard Dilaan Morais.
Abdul Razak told reporters outside the court that the new date for mention would be set by the Registration Division of the Shah Alam High Court before the case is transferred to the Kuala Lumpur High Court in Jalan Duta to be tried with the others accused in this case.
On September 28 last year, Murugan was charged with abetting six men in Kevin’s murder at Desa Mentari here between 9.30am and 8pm on September 4 last year.
Meanwhile, Col K Kunaseegaran, 52, was charged with abetting six men, namely G Gunasekaran, 47; R Dinishwaran, 23; A Thinesh Kumar, 22; M Vishwanath, 25; S Nimalan, 22; and S Ravi Chandaran, 44, in Kevin’s murder.
The six men and the military doctor were charged in the Kuala Lumpur Magistrate’s Court on September 28 last year with tomorrow (January 7) being the date for the mention.
Dr Kunaseegaran, who was the head of the Pathologist Laboratory at the Tuanku Mizan Military Hospital in Wangsa Maju before he was suspended, and Murugan will receive the death sentence if convicted of the crime.
Six other suspects were charged with committing the crime at the same time, date and place under Section 302 of the Penal Code, which was read together with Section 34 of the same code.
Kevin’s remains were found in a cemented drum at Persiaran Subang Mewah, Subang Jaya, near here on September 16 last year.
The deceased was reported missing on September 4 and was last seen leaving his apartment at Menara Duta here to go to Putrajaya in a Proton Perdana bearing registration number WA6264Q.
