KUALA LUMPUR:
A witness told the Traffic Court here today that she saw two Myvi cars, one yellow and the other white, graze the right and left side of a Pajero travelling ahead of her in a tragic accident on the Duta-Ulu Klang Expressway (Duke) which killed three family members last year.

Insurance executive Rosmaliza Mazalan, 42, said she saw the right-side of the Pajero come into contact with the yellow Myvi. The Pajero then skidded to the left and was hit by the white Myvi, she said.

“The Pajero spun several times before coming to a halt in the middle of the road,” she said during examination-in-chief by deputy public prosecutor Suhaimi Ibrahim.

She was testifying in the trial of the two Myvi drivers, Mohammad Fizal Reza Jamauddin, 31, and Siti Noor Aini Mohd Said, 36, who were charged with reckless driving which caused the death of three family members at Km6.2 Duke Expressway, from Ulu Klang heading to Jalan Duta, between 12.31am and 12.35am on May 2 last year.

Those killed in the crash were Fairuz Nizam Husain, 35, his wife Nova Safitri Azhari, 27, and their six-month-old baby, Nur Firuza Annisa.

Rosmaliza, who is the ninth prosecution witness, was among the first individuals to arrive at the scene of the crash.

The woman told the court that she was at the wheel of her car and was returning home to Selayang Heights. She was trailing behind a black Mitsubishi Pajero in the centre lane of the expressway at the time.

As they were approaching a bend, she said she saw, from the rear mirror, the headlights of several vehicles criss-crossing left and right, and a white Myvi car began trailing her car.

“When the Myvi car came close to mine, I decided to give way and take the left lane, but the Myvi car also wanted to go to the left. So I remained on the centre lane. I then saw a yellow Myvi car overtake my car on the right lane.”

Soon after, Rosmaliza said she saw the yellow Myvi car losing control on the right lane and then hit the right side of the Pajero, which was ahead of her car on the centre lane.

Rosmaliza said she slowed down her car and pulled to a stop. She got down from the vehicle after hearing someone saying that there was a baby in the middle of the road.

At that time too, she said, she saw a white Myvi car stop on the left lane, but did not see the yellow Myvi.

Rosmaliza said she approached the baby and found the child motionless.

She left when other passers-by moved the baby to the side of the road and contacted the ambulance and the police.

Questioned by Suhaimi whether she could identify the driver of the white Myvi, Rosmaliza said she could.

“The reason is I almost wanted to punch the driver (at the scene), one, because of the baby (Nur Firuza Annisa) and second, because the driver denied crashing into the Pajero.”

Rosmaliza said the driver of the white Myvi was driving at high-speed.

The hearing before Magistrate Zilfinaz Abbas continues tomorrow.
