Bloomberg Malaysia applies to strike out Bestinet libel suit

Bloomberg (Malaysia) Sdn Bhd claims that the libel suit is scandalous, frivolous or vexatious, and an abuse of the court process.

Bloomberg (Malaysia) Sdn Bhd has applied to strike out a libel suit filed by Bestinet Sdn Bhd and its founder Aminul Islam Abdul Nor over an article linking them to a migrant worker recruitment syndicate.

According to court documents filed at the High Court here by counsel Amer Hamzah Arshad, Bloomberg argued that the plaintiffs’ statement of claim dated Feb 12 was scandalous, frivolous or vexatious, and an abuse of the court process.

It said that it was not the publisher, nor did it cause the publication of the impugned article in January 2026.

It also said it did not upload or disseminate the article, nor does it operate or control the website on which the article appeared.

It pointed out that the Bloomberg website carries a notice stating that it is operated by Bloomberg LP in New York, US, and not by its Malaysian entity.

In the suit, the plaintiffs named 10 defendants: Bloomberg LP, Bloomberg (Malaysia) Sdn Bhd, The Edge Communications Sdn Bhd, Mnow Media Sdn Bhd, Mkini Dotcom Sdn Bhd, Norhafizan Muhamad, Nur Azwan Nusi, Latheefa Koya, Rafizi Ramli and Iswardy Morni.

During case management today, Justice Roslan Mat Nor fixed June 26 to hear the striking-out application.

Bestinet and Aminul Islam were represented by counsel N Ravindran.

Melanie Lim appeared for The Edge, Nurul Najwa Zainuddin for Mnow Media, Soo Siew Mei for Mkini Dotcom, Azhar Arman Ali and Nik Zarith Nik Moustapha for Rafizi, Sufyan Wafiq for Iswardy and N Surendran for Latheefa.

Counsel for Norhafizan and Azwan were not present today. The court asked Ravindran to update it later on whether he had successfully served the writ of summons on Bloomberg LP.
