Court rejects bids by Muhyiddin and Puad in suit by ex-PM

The former prime minister is suing Puad Zarkashi over a Facebook post which he says implied that he refused to undergo mandatory quarantine.

The High Court here has turned down Umno supreme council member Puad Zarkashi’s attempt to set aside a temporary injunction filed against him in a defamation suit by former prime minister Muhyiddin Yassin.

Judge Mohd Firuz Jaffril also dismissed Muhyiddin’s application to extend his injunction against Puad pending disposal of the defamation case.

“In summary, there is no injunction against Puad from today with regard to his (deleted) Facebook post,” he said, explaining the effect of both applications today.

“Having said that, all is not lost for the defendant (Puad). If he succeeds at the end of the (defamation) trial, the court can make a determination on the matter,” he added.

Puad is being sued by Muhyiddin over a Feb 9 Facebook post, entitled “Kuarantin Pun Ada Dua Darjat”.

Muhyiddin contended that Puad’s post implied that he refused to undergo a 10-day quarantine upon returning from an official visit to Indonesia on Feb 5.

The Prime Minister’s Office also issued a statement, saying that Muhyiddin was required to undergo home quarantine, including wearing the quarantine wristband.

Muhyiddin then secured a temporary injunction against Puad over the social media post, which has since been deleted.

The former prime minister was represented by lawyers DP Naban and Rosli Dahlan while Rajasingam Gothandapani and Shahrul Fazli Kamarulzaman are appearing for Puad.

Shahrul said the defamation suit had been fixed for case management on Dec 9 before a new judge, Hayatul Akmal Abdul Aziz, as Firuz is scheduled to be transferred to the Shah Alam High Court.
