
Magistrate Shahril Anuar Ahmad Mustapa granted the order at the request of the prosecution.
Earlier, deputy public prosecutor Lim Leong Hui told the court the Attorney-General’s Chambers had decided to withdraw the charge, brought under Section 186 of the Penal Code, following a review of Khoo’s health condition.
“We have reviewed the case and medical report, and the AGC’s instructions are to withdraw (the charge),” he said.
Lawyer Rajsurian Pillai appeared for Khoo.
Last month, the court was informed that Khoo’s cognitive disorder had deteriorated, leaving him unfit to stand trial or give evidence.
Khoo was ordered last year to enter his defence to a charge of preventing Petaling Jaya city council enforcement officer Azizul Azzim Norehan from carrying out his duties on the night of March 22, 2023.
The incident, captured on video, was alleged to have occurred at Taman Kanagapuram in Section 18 here.
