PETALING JAYA:
The Land Public Transport Agency (Apad) has revoked the operating licence of a trailer lorry company involved in a fatal crash in Segamat, Johor, following findings of serious safety breaches.

The decision comes after an incident on April 2 where a trailer lorry collided with a van carrying a family of five, triggering a chain collision that claimed three lives, including a husband and wife. Two others were seriously injured.

In a statement today, Apad said  its investigations revealed that MFG Barokah Enterprise had failed to comply with key safety requirements, including proper vehicle maintenance and effective monitoring of driver behaviour.

It also found that the company had past records for traffic violations, including speeding.

Apad’s licence suspension and revocation committee, which met yesterday, decided that the company had breached multiple conditions under the Land Public Transport Act 2010 (Act 715).

“The company’s operator licence has been revoked, effective today. It is barred from providing any transport service using vehicles under its licence,” it said.

Apad said all licensed operators must adhere strictly to safety regulations. Failure to do so could result in severe penalties, including licence revocation, as part of efforts to ensure a safer land transport system.

Transport minister Loke Siew Fook had instructed Apad and the road transport department to audit and investigate the firm, stating it must be held accountable for the incident.

The lorry driver was charged with three counts of murder on Tuesday.

Shafiq Salleh, 29, was charged with killing S Palamiandy, 77, K Myakrishnan, 72, and S Sevendai, 62 at Km212 Jalan Johor Bahru-Seremban at 3.50pm on April 2.

Police previously said Shafiq tested positive for drugs after the incident.

While Shafiq has not been charged with a drug offence, police said he would be prosecuted for drug consumption after they receive the pathology report.
