MPs can resign but can’t seek re-election for 5 years, says minister

Liew Vui Keong says this is stipulated in both the Federal Constitution and state constitutions.

KUALA LUMPUR:
The government will not bar MPs from giving up their seats but they will not be allowed to seek re-election for five years, a minister in the Prime Minister’s Department said.

Liew Vui Keong said this was provided for under Article 48 (6) of the Federal Constitution.

The de facto law minister said this was also stipulated in the state constitutions for assemblymen who resigned.

Liew disclosed this in his written reply to Nik Mohamad Abduh Nik Abduh Aziz (PAS-Bachok) who asked whether the government intended to review the regulations to prevent MPs from resigning without a valid reason.

“This matter needs to be scrutinised in more detail before any decision can be made,” said Liew in his reply.
