
Judge Nazlan Ghazali made the order after fiat prosecutor V Sithambaran said a video on the trial had been uploaded to Facebook last week.
“No form of recording should be uploaded online, including the CRT video,” he said, adding that the police are investigating the matter.
“I would like to remind everyone not to make comments or analysis that may be prejudicial to the trial.”
Last Thursday, a video of Najib’s trial was uploaded on the Facebook page of his former special officer, Isham Jalil.
The video showed Najib’s lawyer, Muhammad Shafee Abdullah, cross-examining two witnesses.
Sithambaran told the court earlier that the prosecution wished to draw attention to this video.
He said the CRT is meant to help lawyers and deputy public prosecutors prepare their notes of proceedings.
“When lawyers and prosecutors make applications to obtain the CRT from the registrar, we have to give our undertaking that we will not distribute the video because it is meant only for trial purposes.”
He added that Malaysia has no laws allowing individuals to post court proceedings online.
However, Shafee said all trials in Malaysian courts are open to the public. “We do not have secret trials,” he added.
“This is another case in which we were given 24-hour notice by the prosecution about bringing up this issue.
“The police also say they are investigating the video. In our view, we should not jeopardise their investigation,” he said.
Police are reportedly probing the matter under Section 203A of the Penal Code for disclosure of information, as well as Section 233 of the Communications and Multimedia Act.
Najib, 66, is facing three counts of criminal breach of trust, one charge of abusing his position, and three counts of money laundering over SRC International Sdn Bhd funds amounting to RM42 million.
