Lawyer Mior Nor Haidir Suhaimi said this to reporters after Pejuang’s judicial review proceedings at the High Court here today.
“We received RoS’ letter late yesterday afternoon informing us that they have decided to reject our registration.
“As this judicial review is centred on RoS’ inaction to our registration application, it is now rendered academic,” he said.
Mior said Pejuang was, therefore, withdrawing its application to initiate a judicial review over the delay by RoS and would seek further instructions from the pro tem secretary-general, Amiruddin Hamzah, on the next course of action.
Under the Section 7 of the Societies Act, an aggrieved party can appeal against RoS’ decision to the home minister within 30 days.
Pejuang had earlier filed a challenge against RoS’ “inaction”, seeking to compel the government to make a decision on its registration.
The party wanted a declaration that the “inaction and omission” by RoS and its director-general to register it was unreasonable and done in bad faith.
Mahathir had also lamented that he had yet to receive an approval for the party’s registration, although all requirements had been met.
Pejuang was set up as an independent Malay-based party after a faction linked with Mahathir split from PPBM, which was also founded by the former prime minister.
The other founding members of Pejuang are Jerlun MP Mukhriz Mahathir, Sri Gading MP Shahruddin Md Salleh and Marzuki Yahya.
Mahathir had said the party’s goals were to fight corruption, adding that other Malay-based parties had strayed from their original paths and had been swayed by money and power.
