
The prosecution had appealed against the RM10,000 fine meted out by the High Court against Danial Abdullah Tan, 33, who was initially sentenced to 12 years’ jail for the offence by the Petaling Jaya Magistrates’ Court.
A panel of three judges, led by Abdul Karim Abdul Jalil, dismissed the appeal after deputy public prosecutor Faizah Mohd Salleh informed the court it had filed a notice to withdraw it on Nov 17.
Lawyer Azura Alias, representing Danial, did not object to it.
The other two judges on the panel were Lee Swee Seng and Supang Lian.
On Jan 20 last year, the Shah Alam High Court allowed an appeal by Daniel to set aside the 12-year jail sentence imposed by the Magistrates’ Court on May 31, 2019 and replaced it with a fine of RM10,000, in default 12 years’ jail.
Danial, then a store assistant, who had pleaded guilty to the charge, paid the fine.
He was charged with committing mischief by smashing the front windscreen of a car belonging to Siew Chean Voon, 60, with his helmet, causing losses of about RM600, at Jalan Kasturi in Taman Bukit Serdang, Seri Kembangan, near here at 5.30pm on May 28.
Danial had told the court he was riding his motorcycle when the car almost rammed into him, adding that he smashed the windscreen in anger when Siew pointed at him.
The incident was recorded by Siew’s dashcam camera and the recording went viral on social media.
