A policeman told the High Court today he was not given any specific instructions in respect of an operation to check the car of a man found with drugs and two imitation pistols.

Chong Choon Khen, a police sargeant who was part of a raiding party, said his superior, Wan Muhammad Wan Ali, informed him that the target was a dark blue car bearing registration number PMH 6391.

“However, I was not told where the vehicle was parked,” he said when cross-examined by lawyer Rafique Rashid Ali, who is appearing for Yusoff Rawther, a former research assistant to Anwar Ibrahim.

Rafique: Were you briefed that there were pistols in the car?

Chong: No.

Rafique: I put it to you that there were other specific instructions before the raid was conducted.

Chong: I disagree.

Chong, the seventh prosecution witness, said he was at the location for two hours from 7am. He said the policemen were in plainclothes.

He said he detained the accused a few minutes after approaching the car.

He said he saw Yusoff attempt to open the car using a remote control, and did not see him open the car doors using a manual key.

He disagreed with Rafique’s suggestion that other members of the raiding party had also attempted to open the doors using a remote control key.

Chong said he was assigned the task of arresting and handcuffing Yusoff after an imitation pistol was discovered in the front passenger seat of the car.

He said Yusoff had told him that the bag did not belong to him.

Rafique: Did you handcuff the accused after the discovery?

Chong: No, I did it on the order of Wan Muhammad.

He said a member of the raiding party later drove Yusoff’s car away, with him and the accused seated in the rear passenger seat.

They stopped at the car park of a surau located within the Kuala Lumpur police headquarters premises.

A second search was conducted by the same raiding party which discovered a compressed lump, suspected to be cannabis, under the rear passenger seat.

Yusoff claims the pistols and the drugs were planted by the police to build a case against him.

He is accused of trafficking in 305gm of cannabis found in the vehicle when it was parked in front of the surau at 10.15am on Sept 6, 2024.

The drugs were allegedly wrapped in a black plastic bag.

The charge, framed under Section 39B(1)(a) of the Dangerous Drugs Act 1952, provides for life imprisonment and also whipping of not less than 12 lashes upon conviction.

Yusoff is also charged with possessing two fake pistols outside the Senada Condominium on Jalan Bukit Kiara at 9.25am the same day.

The imitation pistols were allegedly wrapped in a black plastic bag.

The charge, under Section 36(1) of the Arms Act 1960, carries a maximum penalty of one year in prison, a fine of up to RM5,000, or both, upon conviction.

The trial before Justice Jamil Hussin continues tomorrow.
